Terms and Conditions of Use

These Terms and Conditions of Use aim to establish the General Conditions for using the platform and services of BURH SERVIÇOS DE INTERNET LTDA., manager of the website burh.com.br and the BURH application. They are in accordance with applicable legislation, especially Law 13,709/2018 (General Data Protection Law – LGPD) and Law No. 12,965/14 (Brazilian Civil Rights Framework for the Internet).

Acceptance of these Terms is absolutely essential for using the BURH Platform and the Services. Therefore, for proper use, you must read, ensure you have understood, and accept all conditions set forth herein.


1. Definitions and Terms

To facilitate understanding, here are the main definitions of the terms used:

“USER” means the party seeking job opportunities, training and professional development; an individual who uses the BURH platform.

“COMPANY” means companies that use the BURH platform with the objective of accessing the user registration database, publishing job opportunities, or identifying potential talent among them and selecting candidates to join their team using the various technologies available on BURH.

“PARTNER” means external partners available on the BURH platform, whether via “API” or not, whose purpose is to offer a free or paid service to the “USER” and the “COMPANY”. These approved partners have no partnership or corporate relationship with BURH.

“TCU” means the Terms and Conditions and Use Policy to which USERS and the COMPANY are bound; “THE PARTIES” means that both USERS and the COMPANY are bound by these Terms and Conditions, the Use Policy, the Brazilian Civil Rights Framework for the Internet, and the General Data Protection Law (Law 13,709/2018).

“LGPD” is the Brazilian General Data Protection Law, Law No. 13,709/2018, which regulates personal data processing activities and also amends articles 7 and 16 of the Brazilian Civil Rights Framework for the Internet, and to which all parties represented here are bound.

“DPO” (Data Protection Officer, a term originating from the European regulation) is the professional in charge of personal data processing, who must advise and supervise the company so that it complies with all obligations established by law.


2. Changes

These Terms may be changed from time to time for valid reasons. Whenever there is a relevant change, BURH will use its best efforts to notify you and request a new acceptance of the most up-to-date version. However, we ask that you visit this page periodically to check the most recent Terms established for using BURH.


3. Purpose of the BURH Platform, Ownership Rights and Support

a) Purpose

To offer the USER, free of charge, access to opportunities available in their region, freely connecting USER and COMPANY, with the ability to apply for jobs, perform searches, use various filters, among other features.

To offer the COMPANY free access to USERS registered on BURH, enabling the use of searches, filters, résumé downloads, tests, assessments, video interviews, among others.

b) Ownership and Intellectual Property Rights of BURH

The elements, tools, systems, layout and licenses are owned by BURH under applicable law and copyright, as well as the registered trademark BURH. The USER acknowledges and agrees that the creation, inclusion or disclosure of any content in the BURH service does not generate or imply any image rights, ownership or remuneration for them.

c) Limitation

There may be sporadic cases beyond BURH’s control that may cause temporary unavailability of access to the Platform or the Application, due to fortuitous events or force majeure. BURH provides full technical support for its services through the company’s communication channels.


4. Users’ Rights and Duties

The USER’s complete registration must be periodically updated to increase the chances of being invited to job interviews. It is the USER’s responsibility to ensure the truthfulness and updating of their information on BURH. The USER is prohibited from distributing, modifying, selling, renting, or any other form of economic exploitation on the BURH platform.

If the USER receives unusual or suspicious requests such as illegal charges, suspicious advantages, discriminatory job postings, among other possible issues, they must immediately notify BURH through its communication channels by phone at +55 4003-4341, via chat available under Help and Technical Support, or by email at [email protected].
The USER acknowledges and agrees that the COMPANY is free to publish its jobs and to define the job profile requirements and selection flow; under no circumstances may BURH be responsible for any losses or damages of any kind that the parties may claim to have suffered.

a) Applying to recruiting processes and posted jobs

The USER must pay attention to the requirements for each job they apply to. The USER may follow COMPANIES they are interested in and track jobs on BURH.

The USER may apply to the job of their interest, as well as take tests, exams or assessments requested by the hiring COMPANIES, which will be provided through partners connected via API. BURH does not promise or guarantee the USER’s hiring, nor does it interfere with the pre-selection or screening performed by the COMPANY.

b) Minimum legal working age in Brazil

Only USERS who are legally allowed to work under Brazilian law, aged 16 or older (or as an apprentice under Law 10,097/2000) with approval from the competent authorities. It is emphasized that if the USER is under 18 years old, their parents’ consent is mandatory for accepting these Terms and the Privacy Policy.

c) Video Interview

BURH offers a video interview tool through its own partner via “API”, at no cost to the USER. The USER expressly agrees to be interviewed via video interview, with possible recording. By using this feature, the USER consents that they may be evaluated for selection processes and that their interview may be recorded and stored by the hiring COMPANY. If the USER does not want to participate in the video interview, they may ignore the request at the time of the call.


5. Compensation for Damages Caused by the Parties

The Parties will be responsible for, and reimburse, damages caused to BURH or third parties when the Parties: falsely or illegally create content, information, images, photos, or comments about others or themselves, characterizing unlawful acts that cause harm or losses to someone; or disseminate or install viruses or any other code, file or software with the purpose of interrupting, destroying, improperly accessing, limiting or interfering with the operation or security of the BURH service.

a) The COMPANY is prohibited from posting discriminatory ads or job opportunities and will be responsible for its acts and must immediately remove any postings that may violate other people’s rights.

b) The Parties will be responsible for losses due to information leakage caused by improper use or loss of their password, even if by third parties.

c) The Parties exempt BURH from any liability arising from any acts they practice contrary to the provisions of these TCU and the Privacy Policy.

d) The Parties acknowledge and agree that BURH, upon becoming aware of any violation of these TCU or the Privacy Policy, may block or permanently cancel the Parties’ postings or registrations on the website, regardless of prior notice.

e) When displayed as (Verified Real Company and Job) by BURH, it suggests that all jobs and companies have been checked and validated by the BURH control system. Therefore, any irregularities, inconsistencies or other issues cannot be the responsibility of BURH.


6. Acceptance by the Parties of the TCU, Privacy Policy, Web Partners and Video Interviews

By creating their account, the USER and the COMPANY accessed and formally accepted the TCU and the Privacy Policy of BURH. As BURH is constantly evolving, it requests that USERS and the COMPANY periodically review the TCU and the Privacy Policy.

Services offered by BURH may be conditioned on a new acceptance by the Parties when updated (TCU and Privacy Policy). When BURH changes its TCU, it notifies the Parties via email, chat and on the profile page on the platform; the Parties’ acceptance is mandatory.

a) Creating an account, truthfulness of information and access password

  • i. Creating an account: both USER and COMPANY may, at their sole discretion, create their account on BURH, always for the purpose of the platform.

  • ii. Truthfulness of information: the USER is free to fill in the information they want on their résumé on the platform. The USER and the COMPANY must configure and manage their profile, always through login access. USERS are recommended to provide as much information as possible to complete their registration for display to COMPANIES. Information may be updated periodically and must be true, objective, current, and relevant to the purpose of seeking opportunities, as well as their comments.

  • iii. Access password: all access to the Parties’ accounts is through an individual and non-transferable password; safeguarding and confidentiality are the Parties’ responsibility. Images used in their registration are the Parties’ sole responsibility.

  • b) BURH Platform Partners

    Through web partners, BURH provides various services promoted by such partners, whose Privacy Policy and Terms and Conditions are their own and independent. BURH recommends that the USER and the COMPANY carefully read such terms, as there are paid and free services, before undertaking any obligations with these partners. Therefore, BURH is not responsible for any commercial relationship between the USER or the COMPANY and the partners on the platform.

    c) Use of Video Interview by the Parties

  • i. The COMPANY, by using this tool, undertakes to use Video Interview exclusively to interview users and professionals freely, without any discriminatory criteria, always in compliance with applicable law.

  • ii. The videos will be the property of the COMPANY for which the USER was evaluated and may not be provided to other COMPANIES or to third parties, and will be available after recording.

  • iii. The USER and the COMPANY are solely responsible for the use of the videos and for compliance with applicable law, being liable for any misuse, use in violation of the law, video leakage, and losses caused to USERS, the COMPANY or any third party.

  • iv. The USER declares they are aware that BURH will not filter the videos sent by USERS and, therefore, is not responsible for any offensive or illegal content contained therein.

  • 7. Hiring Companies: Rights and Duties

    The COMPANY must use the platform tools to search for USERS for its jobs, conduct searches, virtual interviews, and assessments of USERS, always in compliance with applicable law and respecting the platform’s purpose and BURH’s privacy policy. The COMPANY is prohibited from distributing, modifying, selling, renting, assigning user information or any other form of economic exploitation of the BURH service.

    a) Candidate screening: by analyzing résumés, the COMPANY screens and selects candidates whose profile best fits the needs of the job, and may include them in the selection process or not, up to the end of the hiring process.


    8. Questions, Complaints, Ombudsman and Account Cancellation

    BURH provides direct communication channels for any needs. In case of questions, suggestions or complaints, the Parties may contact BURH through its communication channels by phone at +55 11 4003-4341, via chat available under Help and Technical Support, or by email at [email protected].

    a) Account cancellation by the Parties

    The BURH service is provided for an indefinite term; however, the USER and the COMPANY may cancel these services at any time through BURH’s communication channels via [email protected].

    If the Parties do not agree with the content of these TCU, they are absolutely free to decide whether or not to use the services provided by BURH.


    9. Jurisdiction

    The Parties elect the Central Court of the District of Sorocaba/SP to resolve any disputes and claims arising from or related to these TCU, waiving any other jurisdiction, however privileged it may be.
